I bought land in 2007 now I disqualify for first time home buyer's credit?
In 2007 I bought a 5 acre parcel of dirt for investment purposes. I was given a Form 1098 to fill for it, and then I lost the land in 2008 due to fraud and theft. I never owned a house on it and I never declared it my primary address. During this time I lived with my parents until May 2009 I bought my first house ever. I applied for First time home buyer credit, but was denied because I filled a form 1098 on my 2007 tax returns. How can I fight this? What do I need to provide to prove I never lived in a different state and owned a house on it. It was just dirt when I entered into a contract for deed. I never received a deed… so how can I show the IRS I am okay for the credit. They saw the 1098 and threw a red flag, but I never lived on an unamed dirt road in the middle of nowhere. Any help please!
The landowner sent me the 1098 form. I did my taxes using turbotax and the form needed to be entered. He was selling the same parcel of property to more than one investor and that was fraud. I had to sue him to get my money back. So how can I prove that I never lived there… I never declared that property as my primary address.
I never intended to write off anything, the landowner sent me the 1098 form. I just followed the turbo tax procedures.
I entered into a Contract for Deed on a parcel of five acres of undeveloped land with the landowner in 2007. A deed was never issued or registered in my name. I never took out a loan and I cannot provide a physical address because there is only a dirt road that leads to these barren lots. This was an investment to buy land and sell it at a later time. I sued the landowner for fraud and we settled the case where my monies I had invested were returned to me.

This seems like a very selective telling of the "facts." Just why did you never have a deed, how did you lose the land to "fraud and theft" and who issued the 1098 to you and what was it for?

You screwed up. You wil be damn lucky if they do not come after you for fraud. You committed income tax fraud sending in the 1098, that is for mortgage interest for your primary residence. You were no entitled to take that write off, as you said, it was not your residence. Hell, you never even had a mortgage, you can’t write off rent to own contracts even if you live in them.
You have to prove you committed fraud for the credit, and it is certainly in your best interest to stay low for until 2018, they can prosecute you until then and will if a person look at this. Right now you were thrown out by a computer.
